Background: Background: The Coastal Zone Management (CZM) Act was amended in 1990 to address nonpoint source (NPS) pollution. Section 6217 of the Coastal Zone Act Reauthorization Amendments of 1990 requires that states with approved coastal zone management programs develop and implement coastal NPS pollution programs. Federal guidance issued in 1993 requires that 56 specific management measures be met through enforceable state policies and mechanisms. In addition to the management measures, states are required to monitor and track program implementation. Failure to develop an approved program may result in substantial funding penalties under Section 319 of the Clean Water Act and Section 306 of the CZM Act.
Purpose: The statute is meant to restore and protect coastal water quality through the application of economically achievable "best management practices" implemented through enforceable state policies and mechanisms. The federal government defines these policies and mechanisms as state and local regulatory controls and/or non-regulatory incentive programs combined with state enforcement authority.
Program development: DCR is the state's lead agency in administering the coastal nonpoint source pollution control program. Working with the Department of Environmental Quality, other state agencies and federal personnel, DCR staff coordinated the development of a comprehensive assessment of state programs applying to management measures specified in federal guidance. That assessment formed the basis for development of a Coastal Nonpoint Source Pollution Control Program document that was submitted to the National Oceanic and Atmospheric Administration (NOAA) and the U.S. Environmental Protection Agency (EPA) in September 1995. Virginia received draft conditional program approval from NOAA and EPA a year later. The state then received final conditional approval in February 1998 . Full program approval was contingent on Virginia's satisfaction of specific program conditions over a one- to three-year time period. Satisfying these conditions required a multi-agency effort to address programmatic and regulatory changes.
Program implementation: Virginia received full federal approval on May 16, 2001. The final approval letter for Virginia's program can be found here. To more effectively support and promote implementation of the coastal nonpoint program, it has been integrated with the Section 319 Nonpoint Source Pollution Management Program as part of Virginia's overall work to address NPS pollution. Actions presented in the DCR Section 319 document are implementation mechanisms for the program.
