Public Comment Period

On June 22, 2009, the proposed Parts 1, 2, 3, and 13 of the Stormwater Regulations were published in the Virginia Register starting a 60-day public comment period that ended on August 21, 2009. Five public hearings were held regarding these proposed regulations.

• Economic Impact Analysis of Revisions to the Virginia Stormwater Regulation

  The report entitled Economic Impact Analysis of Revisions to the Virginia Stormwater Regulation (December 31, 2008) is available at the link below and was prepared by researchers in Virginia Tech's Department of Agricultural and Applied Economics under contract with the Department of Conservation and Recreation (DCR). While DCR offered input and comments on the Virginia Tech report, the authors note that all statements, conclusions, omissions, or errors are the sole responsibility of the authors.

  The report will be used as part of DCR's analysis and discussion of the economic impacts associated with the proposed Stormwater Water Quality and Quantity Technical Criteria and Local Program Criteria (Parts I, II, and III) regulations and the proposed Stormwater Fees regulations (Part XIII) that were authorized by the Virginia Soil and Water Conservation Board on September 24, 2008 to go out for public comment before they consider final adoption later in 2009. This report will be used to supplement the Department's more comprehensive economic analysis of the proposed regulations that will be presented in the regulatory support documents that will accompany the filing of the proposed regulations on the Commonwealth of Virginia's Regulatory Town Hall. DCR's analysis, which will be released to the public following the required internal state government review and prior to the public comment period, will include an overview of both the potential benefits of these regulations as well as an analysis of the costs associated with their implementation.
